Abstract: Abstract: This thesis examines the constitutional guarantee regarding the requirement to provide reasons for judicial decisions (the duty to state grounds) in first-instance judgments in Ecuador. To this end, criminal case No. 13283-2018-XXXXX, concerning the crime of breach of trust, has been selected as a case study. The aim of this study is to verify whether lower-court judicial decisions comply with the parameters of sufficiency, clarity, and coherence established by the Constitutional Court in judgment 1158-17-EP/211. Employing a qualitative methodology and Manuel Atienza s argumentative approach, the study details the logical structure of the ruling in question to determine the existence of potential flaws in the reasoning provided. This work offers a critical perspective on the practical application of Article 76.7(l) of the Constitution, establishing that a sound factual and legal basis is essential to prevent arbitrariness and guarantee the right to a defense. This study serves as a reference tool to strengthen legal argumentation within the ordinary justice system.
