Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract:This study analyzes and examines Judgment No. 13315-2023-00267, issued by the Multi-Competent Judicial Unit based in the Santa Ana Canton regarding a constitutional law matter. The judgment resolves an action for constitutional protection (*acción de protección*) filed by XXXX XXXX XXXX XXXX against the Municipal Government of Santa Ana and the Cantonal Council for the Protection of Rights, declaring a violation of the constitutional rights to work, due process, and legal certainty. Consequently, the project's general objective is to analyze the judgment's reasoning identifying the legal and factual arguments underpinning the decision and to evaluate it in light of the importance of reasoning in administrative and judicial decisions. Thus, this work aims to present a detailed analysis of the judgment, identifying the legal issues, relevant questions and sub-questions, as well as the *ratio decidendi* and *obiter dicta*. Finally, the implications are discussed.
