| Abstract: | Abstract:This research paper analyzes the requirement for the substantiation (reasoning) of judgment No. 05333-2024-03616, issued by the Civil Judicial Unit based in the Latacunga Canton, within the context of a legal proceeding for the collection of a bill of exchange. The objective of this study is to evaluate the judicial decision and verify whether it meets the standards for legal reasoning stipulated in the Constitution of the Republic, as well as those established in Constitutional Court judgment No. 1158-17-EP/21. A qualitative methodology was employed, focusing on an analysis of the judgment and legal-doctrinal research. The findings indicate that the judgment in question fails to meet the required standards for reasoning, as it disregards the guiding criteria established by the highest constitutional oversight body. The judgment exhibits a deficiency in its reasoning specifically, an evident flaw characterized by incoherence. It is concluded that legal reasoning is not merely the citation of statutes and principles; rather, it is constructed through technical legal argumentation, which serves to safeguard the rights to due process and legal certainty. |
