Abstract: Recognition of the application of indigenous justice in Latin America in general, and Ecuador in particular, is undoubtedly one of the most momentous acts of justice that took place in the twentieth century, ending with centuries of discrimination and alienation Of the indigenous peoples and nationalities, claiming the history and customs of the same. Nevertheless, in its implementation, and with the passing of the years, many and diverse have been the complaints, regarding respect for human rights in the forms and procedures of said justice. The present study investigates the particularities of the implementation of indigenous justice in Ecuador, with special reference to the communities of Tixán, determining whether in their justice delivery procedures, they violate or violate the human rights of individuals subjected to such Competence, in such a way that it has allowed an objective assessment of the current situation in that parish
Description: El reconocimiento de la aplicación de la justicia indígena en Latinoamérica en general, y el Ecuador en particular, constituye sin lugar a dudas, uno de los actos de justicia más trascendentales que tuvieron lugar en el siglo XX, pues concluyó con siglos de discriminación y enajenación de los pueblos y nacionalidades indígenas, reivindicando la historia y costumbres de los mismos. No obstante ello, en su implementación, y con el devenir de los años, muchas y diversas han sido las denuncias, en cuanto al respeto de los derechos humanos en las formas y procedimientos de dicha justicia. El presente estudio, investiga las particularidades de la implementación de la justicia indígena en el Ecuador, con especial referencia a las comunidades de Tixán, determinando si en sus procedimientos de impartición de justicia, se quebrantan o vulneran los derechos humanos de los individuos sometidos a dicha competencia, de forma tal, que ha permitido realizar una valoración objetiva de la situación actual en dicha parroquia.
