Abstract

Abstract: This work seeks to analyze the violation of the rights to defense, due process and legal security rights that affect the Sustainable Development Goals worldwide, the same ones that were created to achieve a different society for everyone. In this research we will focus on the study of SDG No. 16 who protects peace, justice within solid institutions, protecting the right to access to quality justice, legal security, effective judicial protection, rights of participation, communication and information. Right to good public administration. This ODS is clearly related to the judgment on the extraordinary protection action, issued by the Constitutional Court of Ecuador, in a case of an administrative claim between a private company and the State.In this case, the shortcomings that exist within the public tenders for contracting drugs and the lack of seriousness on the part of the plaintiffs who delivered the requested documents incompletely and filed appeals knowing that they are not going to proceed are brought to light.
