Abstract:This work is an analysis of the violation of the right to due process, the right to effective judicial protection, and how these factors affect the fulfillment of the Sustainable Development Goals, preventing the creation of a balanced society, of peace, of justice, of freedom. access to the justice and security system, situations that do not allow for the development of peoples.Related to the study of SDG No. 16, it is to create a justice system that provides security and trust in users. Objective that is related to a judgment of cassation issued by the Court of the Chamber of the Family, Childhood, Adolescence and Adolescents Offenders of the National Court of Justice of Ecuador, of the demand for Divorce by Causal, using as an argument the abandonment of the home of the plaintiff, violating the guarantees of due process, such as motivation, defense, compliance with regulations; It is said that effective judicial protection is violated, the state must guarantee that constitutional guarantees are respected, this is what allows qualifying a process as fair or due.
