| Abstract: | Abstract: This research analyzes how weak institutions, inadequate access to justice, and violating the right to legal certainty, corroborate compliance with the Sustainable Development Goals worldwide, which aim to achieve an equitable society, fair, safe and above all sustainable for all. Specifically, the study of SDG No. 16 is carried out, which contemplates peace, justice and solid institutions. This objective has been linked to a cassation ruling issued by the National Court of Justice of Ecuador, for a case of physical violence and psychological violence, against women or members of the family nucleus, and a disagreement with the interpretation of art. 20 of the Comprehensive Criminal Organic Code; that they were crimes perpetrated within the same context and by a single person. The present work intends to make known the need that Ecuadorian citizens have for the implementation of a true justice, which ensures their rights established in the Constitution and international instruments, and that the State provides legal security through the drafting and elaboration of the relevant regulations. |
| Description: | Resumen: En esta investigación se analiza cómo las instituciones débiles, el inadecuado acceso a la justicia, y el vulnerar el derecho a la seguridad jurídica, afectan el cumplimiento de los Objetivos de Desarrollo Sostenible a nivel mundial, que tienen la finalidad de alcanzar una sociedad equitativa, justa, segura y sobre todo sostenible para todos. De manera específica se realiza el estudio del ODS N° 16, el cual contempla la paz, justicia e instituciones sólidas. Este objetivo ha sido vinculado con una sentencia de casación emitida por la Corte Nacional de Justicia del Ecuador, por un caso de violencia física y violencia psicológica, contra la mujer o miembros del núcleo familiar, y una inconformidad con la interpretación del Art. 20 del Código Orgánico Integral Penal; delitos que fueron perpetrados dentro de un mismo contexto y por una sola persona. El presente trabajo pretende dar a conocer la necesidad que tienen los ciudadanos ecuatorianos de la implementación de una justicia verdadera, que vele por sus derechos establecidos en la Constitución e instrumentos internacionales, y que el Estado proporcione seguridad jurídica a través de la redacción y elaboración de la normativa pertinente. |
