Abstract:This research work is based on the analysis of the right to education inclusive, through ruling issued by the Constitutional Court No. 1016-20-JP/21, María Fernanda Martínez Pico vs. Laica Vicente Rocafuerte University, for the violation of the right to inclusive education that is detected in this case, which is linked to the Objective of Sustainable Development No. 4, oriented towards the study of fundamental rights contemplated in the Ecuadorian Constitution towards the protection of the rights of "good live". This is generated as a result of the protection action request requested by the university student, who failed the semester for exceeding the percentage of absences and the justifications for attendance were denied by the University, this despite have the support of the medical treatment carried out in SOLCA, derived from their disability, violating the right to inclusive education.
