Abstract

Abstract: This case deals with the right to water and its basic services, with a protection action in the case of indigenous justice, the problem is triggered by the fact that regarding the PUCYU UCU watershed, the community adjoiningtheplaintiff's land, receiveda part of SENAGUAso thatit can use the community landfor irrigation, this is the concession of an amount of 0.40 l/s. At the same time, Mr. Elías David Aigaje Pinango requested on several occasions that they supply him with water for his cattle and the grazing of his farm,to whichthe Cuarto Lote community refused, due to the refusal the plaintiff went to the regional SENAGUA of Esmeraldas to start a water concession process for its use. Followinghis request, SENAGUAproceeds to grant Mr. Elías David Aigaje Pinango the amount of 1.36 l/s. Therefore, the Cuarto Lote community decides to initiate a process to protect the rights of the aforementioned community.
