| Abstract: | Abstract: Within the study of Sentence 1610-2016-MMA, the violation of the right to a fair trial is visualized, and the actions of the institutions that are obliged to support the rights of all. In this sense, this problem is related to SDG 16, since its purpose is to monitor state institutions and their correct functioning in favor of justice; however, the objective and the sentence contradict each other. Therefore, within the present research, a legal analysis has been carried out on the subject of study as well as the goals proposed by SDG 16, and according to this it has been possible to delve into legal knowledge, allowing the development of the critical thinking necessary for the carrying out pertinent analyzes in the resolution of real processes, managing to issue an adequate opinion based on law. |
| Description: | Resumen: Dentro del estudio de la Sentencia 1610-2016-MMA, se visualiza la vulneración del derecho a un juicio justo, y la actuación de las instituciones que tienen por obligación el respaldo de los derechos de todos y todas. En este sentido, se relaciona a esta problemática con el ODS 16, puesto que su fin recae en vigilar las instituciones estatales, su correcto funcionamiento a favor de la justicia, sin embargo, el objetivo y la sentencia se contraponen. Por tanto, dentro de la presente investigación se ha realizado un análisis jurídico en la materia de estudio como de las metas propuestas por el ODS 16, y acorde a esto se ha podido ahondar en el conocimiento jurídico, permitiendo desarrollar el pensamiento crítico necesario para la realización de análisis pertinentes en la resolución de procesos reales, logrando emitir una adecuada opinión fundamentada en derecho. |
