Abstract

Abstract: The present study promoted the importance of compliance with the right to health, which should be guaranteed by the State. This right was linked to the exercise of other rights, such as access to water, food, education, physical culture, work, social security and healthy environments, all essential for good living. The objective was to know the factors that come together in the graduate of the UTPL Law degree to develop preferences for specific areas of legal science and their future specialization in these. The methodology used was systematic in nature, oriented to the review process of jurisprudence, legal norms and doctrine, was of a theoretical-deductive type. Furthermore, by integrating a link between Law and social and economic phenomena, the study acquired a socio-legal character. The main findings were framed in establishing the relevance of this universal right in the context of the Sustainable Development Goal number 3, aimed at guaranteeing access to the health system. Likewise, the vital importance of supporting this right with robust legal systems and legal regulations. In Ecuador, there were multiple laws and signed international treaties that sought ensure human rights, including the right to health. The review of the sentence judicial and the motivations behind it revealed failures committed by the Ecuadorian State, resulting in human rights violations. The court decision was considered correct, reaffirming the commitment of the states party to international treaties in matter of human rights. This ruling not only resolved the case in question, but also It also established a useful and exemplary precedent for the future.
