Abstract

Abstract: This work encompasses the detailed analysis of judgment number 35-12-IN/20, the Notarial Law, and the Constitution of the Republic of Ecuador. The notarial service, as a crucial auxiliary organ of the Judicial Function, plays a fundamental role in determining and guaranteeing the public services that the State must provide in a timely and effective manner. The regulatory body of notaries not only sets fees for notarial services of legal acts but also oversees the total incomes of notaries and the quality of service and attention provided to users. Although notarial services combine elements of both public and private nature, notaries, as public servants, are vested with public faith. This gives them the authority to formalize legal acts conducted in their presence, as well as the responsibility to manage and remunerate their personnel, whose incomes are linked to a percentage of notarial revenues allocated to the State. This study focuses on thoroughly analyzing the current state of fees for notarial services, exploring the remuneration structure of the notarial system, the legal framework governing the collection and use of these resources, and the inherent responsibilities as established in the Ecuadorian Constitution of 2008. The primary objective is to discern how the State intervenes and regulates the provision of notarial services, ensuring their proper function within the national legal context.
