Abstract

Abstract: The sentence analyzed reveals the violation of fundamental rights of minors, especially the right to the best interests of the child and the right to be heard in judicial processes that directly affect them. The judges did not consider the emotional and psychological well-being of the children or take their opinion into account, which constituted a clear violation of these rights. This lack of attention to the needs and perspectives of minors contradicts Sustainable Development Goal 16 of Peace, Justice and Strong Institutions, which seeks to ensure equitable access to justice and promote peaceful and inclusive societies. The ruling highlights the importance of protecting the human rights of children and underlines the need for a judicial approach that prioritizes the well-being and active participation of minors in decisions that directly affect them, in accordance with the principles of justice and equity.
