Abstract

Abstract: This study examines judicial rulings, such as Case No. 2936-18-EP and Sentence No. 2936-18-EP/21 of the Constitutional Court of Ecuador, which reveal the vulnerability of the rights of an elderly person. affected by a catastrophic illness. This ruling highlights the importance of protecting individual rights and ensuring fair application of the law. From the perspective of Criminal Law, an alleged violation of rights is analyzed that could imply negligence or abuse of authority on the part of institutions such as the IESS. The review of laws and institutions is suggested to improve the protection of constitutional rights. In addition, the relationship with Sustainable Development Goals (SDG) 3 (Health and Wellbeing) and 16 (Peace, Justice and Strong Institutions) is highlighted, underlining the importance of promoting peaceful and inclusive societies to guarantee healthy lives and respect for fundamental rights in society.
