Abstract

Abstract: This research analyzes Sentence No. 1024-19-JP/21 of the Constitutional Court of Ecuador, which addresses the unfair suspension of Gallo's pension payments Patiño Quesada, Marisa Liliana Saavedra Chaisin and their children, awarded by the Institute Ecuadorian. of Social Security (IESS). This suspension seriously violated their fundamental rights related to social security. The study highlights the importance of social security as a fundamental right and responsibility of the State in its protection. Furthermore, it highlights the correct implementation of the article 94 of the Social Security Law to avoid future violations. The sentence dictates compensatory measures, including a public apology, financial aid and administrative sanctions, demonstrating the significant impact of the decisions judicial in the protection of social and economic rights. The main objective of the research is to evaluate the role of the Constitutional Court in the protection of citizens' rights to social security. The methodology used is a qualitative analysis of legal documents, jurisprudence and legislation relevant to evaluate the effectiveness of legal mechanisms in guaranteeing the social security rights. This work reinforces the need for a system of robust and efficient social security and highlights the crucial role of the State in guaranteeing it.
