Abstract

Abstract: The present investigation is part of the project of the Socio-Humanistic Area of the Technical University of Loja with a view to characterizing the Ecuadorian legal framework for lawyers in free exercise, and in particular it focuses on discussing the constitutionality and necessity of the exercise of the Disciplinary power by the Council of the Judiciary with respect to said Lawyers, regardless of the necessary ethical control to which the performance of the latter must be subject. Through a previous theoretical analysis, reinforced with the application of a survey to the Lawyers in free exercise and a punctual interview to a professional of vast experience of the Cotopaxi Bar Association, it was determined that there is no constitutional norm that justifies the application of the system of administrative responsibility that has been entrusted to the Council of the Judiciary against the Lawyers in free exercise, in addition to being contrary to principles contained in international instruments on the subject.
