Análisis del pago por consignación como derecho a la liberación de obligaciones en el marco jurídico ecuatoriano

Abstract

Abstract: The present work takes the title of Analysis of the payment for consignation as right to the liberation of obligations in the juridical Ecuadoran frame". The payment as consignation has liberating effects in the frame of the civil law, which spreads to interpretations of the exercise of the freedom of contracting. Therefore, the work of investigation will center on analyzing the payment for consignation as right to the liberation of obligations in the juridical Ecuadoran frame. The realized work is theoretical exploratory since his contributions are directly related to the doctrinaire field. The used methods are the analysis and the synthesis, from which there was done a study of the juridical current frame that allowed to analyze the scopes and limitations that the payment has as consignation in our country. Finally, there was applied a deductive - inductive method consisted of the study and analysis of texts, manuals, codices, and related publications, more a few interviews to several professionals of the justice who contributed his opinion in the matter and who allowed to come to the conclusions of the liberation of the obligations of the payment for consignation in the juridical frame of our country.
