Factores que afectan a la tutela judicial efectiva como derecho constitucional de los justiciables en materia civil durante el año 2014-2015

Abstract

Abstract: This research aims to conduct a study on the factors affecting effective judicial protection as a constitutional right of individuals in civil matters during the 2014-2015 school year, considering that this fundamental right entails access to justice with a minimum guarantees. However an effective remedy prescribed the impartiality of the judge, the immediacy and celerity, prohibits helplessness sets the enforcement of court decisions and determines that sentences are properly motivated demands without which there would be no confidence in the administration of justice. Effective remedy is affecting factors that have not yet been overcome and in this regard include the lack of judicial independence, judicial congestion, the lack of judges and judicial error, etc., factors impeding implementation and recognition for litigants in civil proceedings.
