Abstract

The Union of Fact, was born as one of the oldest forms of human coexistence, commonly known as concubinage. It is so; in the Civil Code and in the Constitution of the Republic of Ecuador, this juridical system is expressly regulated, granting this right when more than two years of coexistence have passed between two persons free of marriage, with the same legal effects as marriage, rights and obligations are generated for the couple and protection is given to the children resulting from this union. We live in a society of progressive rights and many advances have now been made around this institution, so much so that even minorities such as LGBTI are now protected under laws that guarantee their union and offer similar benefits as those heterosexual couples.
