Abstract

Abstract: The purpose of this research work is to carry out a general analysis on the right to retirement in the different regulatory fields and double retirement. I want to analyze a current problem such as the right to retirement of workers. It seeks to study retirement in the private and public sphere, also determining the differences between retirement by the Ecuadorian Institute of Social Security (IESS) protected by the Social Security Law and retirement, supported by the Labor Code and the Organic Law of Public Service, LOSEP. (abbreviation in Spanish) The problematic is a new and very little studied in our country, this is why is so interesting its study and discussion which directly benefits both employers and workers in the public and private sectors, as well as representatives of different legal departments. to be able to apply with ease and rectitude the processes on this right of workers. The work includes a doctrinal, legal and jurisprudence study through the study of 16 cassation cases that have been resolved by the National Court of Justice from the years 2017 to 2019 in which retirement is observed as an inalienable right of the workers, corresponding to the administrators of justice to ensure compliance with this right.
