| Abstract: | Abstract:Fundamental rights have been in constant evolution throughout history, since these rights are born with the human being and are accentuated to the needs in which we live. By its own nature, these rights are not negotiable and as result are managed with different international institutions and supervised by the Supreme Court of each country. There are many laws in the constitution, however; some rights are not guarantee which leads to a violation or the shift in constitutional values. The present investigation, was to determine the failure of the regulation at the legislative level and cultural, as well as a concrete analysis of the actions that would allow achieving a harmonious relation in the society. |
| Description: | Resumen:Los Derechos Fundamentales a lo largo de la historia han ido evolucionando de manera progresiva, puesto que son aquellos que nacen con el ser humano, y por ende se acentúan a las necesidades y realidades de la época en que vivimos. Por su propia naturaleza, referidos derechos no son negociables, y como resultado, se promueven por diferentes instituciones a nivel internacional, y se cristalizan en las distintas normas supremas de cada país. Sin embargo, a pesar de constar en las diferentes legislaciones, muchos derechos no son garantizados y por el contrario son violentados de manera continua y reiterada. La presente investigación, se desarrolló con el objetivo de determinar las distintas falencias a nivel legislativo y cultural, así como un análisis concreto de las actuaciones que permitirían lograr una convivencia más armónica de la sociedad. |
