| Abstract: | Abstract: The general objective of this work is to know the factors that come together in the UTPL Law Graduate to develop preferences for specific areas of legal science and their future specialization in these. In this way, the basis of the research focuses on the doctrinal and legal precepts of Criminal Law as a matter of preference through which the conduct and punishable offenses are observed and the respective sanctions within the study sentence are analyzed. This being cassation appeal No. 0613-2015-JCC where the violation of the right to legal certainty is examined, basing the lack of factual and legal motivation. The analysis is based on the 2030 Agenda of the Sustainable Development Goals of the United Nations, specifically with Objective No. 16 Peace, Justice, and Solid Institutions which aims to promote peaceful societies with access to justice in responsible and efficient institutions at all levels. |
| Description: | Resumen: El presente trabajo tiene como objetivo general conocer los factores que confluyen en el Egresado de la Carrera de Derecho de la UTPL para desarrollar preferencias por áreas específicas de la ciencia jurídica y su futura especialización en éstas. De esta manera, la base de la investigación se centra en los preceptos doctrinarios y jurídicos del Derecho Penal como materia de preferencia a través de la cual se observa la conducta, las faltas punibles y se analiza las respectivas sanciones dentro de la sentencia de estudio, siendo esta el recurso de casación No. 0613-2015-JCC donde se examina la vulneración del derecho a la seguridad jurídica fundamentando la falta de motivación de hecho y de derecho. El análisis se encuentra fundamentado con la Agenda 2030 de los Objetivos de Desarrollo Sostenible de las Naciones Unidades, en específico con el Objetivo No. 16 Paz, Justicia, e Instituciones Sólidas el cual tiene como finalidad la promoción de sociedades pacíficas con acceso a la justicia en instituciones responsables y eficientes en todos los niveles. |
