Abstract

Abstract: We can observe that justice, like many other issues, requires knowledge and honesty to represent and enforce the law fairly, thus avoiding violating the rights of certain individuals in order to protect the rights of others. In this case, we observed the violation of a right. It was important to investigate and analyze all those involved, regardless of their position, social status, or other exclusive characteristics, with the goal of ensuring that the law protects the innocent and that the guilty party accepts their sentence objectively. This allowed the evidence to be drawn on the damage, since the enforcement of an article protected by the law, which provides protection and reparation for damages, was being omitted. This affected a victim of domestic violence, whose rights, under Articles 11 and 83.1 of the Constitution, require the mandatory exercise of these rights and guarantee their compliance. The judge's decision contributes positively to the effective delivery of justice and avoids harm to the rights to due process and good living.
