Abstract

Abstract: On September 2, 2013, María Ernestina Hernández Cevallos and Martha del Pilar Villagómez Garzón, as common attorneys for the group of pensioners of the former Caja Policial, filed an action for non-compliance against the National Police Social Security Institute (ISSPOL), because it suspended the pensions granted to the wives of deceased members of the former Caja Policial, despite the fact that these women had full legal right to receive said pension, which guaranteed them a dignified old age. By suspending this benefit, their rights were violated, which forced them to initiate the corresponding legal actions against ISSPOL, in order to have their rights restored and to guarantee compliance with the legal provisions that support said pension. By filing the action for protection, they wanted to show that the ISSPOL violated the fundamental principles of justice, legal certainty and equality before the law, and that because of this, many pensioners of the montepío were affected, not only in the economic sphere, but also, more seriously, in their psychological aspects and deprived of their rights to health, and because they are mainly elderly people, the same ones who belong to vulnerable groups, their integrity and well-being are affected, without taking into account that they were left unprotected and forced to take greater risks mainly due to the decrease in their physical and mental capacities. On the other hand, the United Nations Organization with SDg 16 seeks to "Promote the rule of law at the national and international levels and guarantee equal access to justice for all", so we can indicate that according to the Constitutional ruling issued in favor of the pensioners of montepío, it is aligned and complied with, restoring their rights and setting legal precedents.
