Abstract

Abstract: Institutions play a leading role in the objectives of both global and individual societies; such is the case of the United Nations, which is home to around 30 countries working towards more just and inclusive societies. To this end, the Sustainable Development Goals (SDGs) were declared, binding on all member countries of this organization, which must comply by aligning their constitutions with each of these objectives. Such is the case of Goal 6 on water and sanitation, which seeks the protection and restoration of water-related ecosystems, as well as the efficient use of resources to ensure that users generally have the greatest access to water in a rational, equitable, and fair manner. The Constitutional Court of Ecuador, based on the Constitution and norms of Ecuadorian law, heard the claim of unconstitutionality regarding the application of the regulation by a public institution (MAE) and, based on the same, determined its inapplicability because it was considered contradictory to the highest-ranking norm. Its ruling requested an amendment to said norm and that the water rights of both the subject and the user thereof be restored.
