Abstract

Abstract: This ruling analyzes whether there is a violation of the right to motivation, compliance with the rules and rights of the parties, equality and effective judicial protection in a ruling of the Specialized Tax Litigation Chamber of the National Court of Justice. The Court declares that there was a violation of the rights invoked by the plaintiff company. Through the sustainable development objectives, we are going to work together to provide a solution that allows us to make the best decision, both for the operating company and the affected institution. The objective of the investigation was to identify the most common causes in which rights were violated and why these types of problems occur. Likewise, we will be able to know how the special consumption taxes for the fiscal year work, analyze the amount that was set and what the reasons were. The conditions and regulations that the country has will be determined through tax law and in this way, we are promoting fair, peaceful and inclusive societies.
