Abstract

Abstract: In the research, an analysis of Sustainable Development Goal No. 16 is carried out, which includes aspects such as peace, justice and the right to the existence of solid institutions that guarantee the aforementioned rights, and allow the construction of democratic, inclusive, diverse and respectful societies. of the human rights of all people without distinction or discrimination. This objective was analyzed in contrast to the Judgment of the CASE GUACHALÁ CHIMBO AND OTHERS VS. ECUADOR JUDGMENT OF MARCH 26, 2021 (Merits, Reparations and Costs), where the violation of the rights i) to recognition of legal personality, life, personal integrity, personal freedom, dignity, private life, access to information was determined , equality and health, in relation to the obligations to respect and guarantee rights without discrimination and the duty to adopt provisions of domestic law that allow the protection of fundamental rights. The responsibility of the State was basically due to the lack of timely diligence and immediate action to find the whereabouts of a person with disabilities in its custody, which had the consequence that to date it has not been determined whether that person is still alive. or has died, since the body has not been found either.
