| Abstract: | Abstract: In this research is analyzed the Sustainable Development Goal no. 16 which includes rights such as peace, justice and the right to the existence of solid institutions that guarantee the rights of all people, and allow the construction of democratic, inclusive, diverse and respectful societies of the human rights of all people without distinction or discrimination. In relation to this objective, the relevant doctrinal and normative references are determined, and then their effectiveness is analyzed through the detailed analysis of a ruling of the Constitutional Court through which it was possible to identify the way in which said body contributes to the realization of the SDG. No. 16. This is JUDGMENT No. 262-16-SEP-CC17 of August 2016, where the plaintiff alleged the violation of his rights to work, fair remuneration, social security and equal opportunities, in addition of the right to legal certainty. After carrying out all the analysis, it was concluded that the aforementioned ruling is a mechanism to achieve SDG no. 16, but that other State actions are required to fully achieve it. Based on this, recommendations are presented. |
| Description: | Resumen: En la presente investigación se analiza el Objetivo de Desarrollo Sostenible no. 16 que incluye derechos como la paz, la justicia y el derecho a la existencia de instituciones sólidas que garanticen los derechos de todas las personas, y permitan construir sociedades democráticas, inclusivas, diversas y respetuosas de los derechos humanos de todas las personas sin distinción ni discriminación. En relación con ese objetivo se determinan las referencias doctrinales y normativas pertinentes, para luego analizar su efectividad mediante el análisis detallado de una sentencia de la Corte Constitucional a través de la cual se pudo identificar la forma en que dicho organismo contribuye a la realización del ODS no. 16. Se trata de la SENTENCIA N.° 262-16-SEP-CC17 de agosto de 2016, donde el accionante alegó la vulneración de sus derechos al trabajo, a la remuneración justa, a la seguridad social y la igualdad de oportunidades, además del derecho a la seguridad jurídica. Luego de realizado todo el análisis se llegó a la conclusión de que la precitada sentencia es un mecanismo para alcanzar el ODS no. 16, pero que se requieren otras acciones del Estado para alcanzarlo a plenitud. Con base en ello se presentan las recomendaciones. |
