Inteligencia artificial y su impacto en la transparencia de las resoluciones judiciales en Ecuador

Abstract

Abstract: The adoption of artificial intelligence (AI) in the administration of justice in Ecuador represents an accelerated transformation process aimed at improving judicial efficiency; however, it also raises tensions with the constitutional principles of transparency, publicity, and adequate justification of rulings. The overall objective was to determine the influence of AI on the drafting, justification, and publication of judicial decisions, as well as to evaluate its impact on these principles. A mixed qualitative-quantitative, correlational methodology was applied, which included normative and jurisprudential analysis, a review of 150 judicial rulings, and a survey of 45 justice system professionals. The results show an average time savings of 40% in the drafting of rulings, recognized by 90% of the respondents. Nevertheless, risks of opacity and algorithmic bias were identified, indicating that the quality of justification can only be guaranteed with human oversight and regulatory updates. In conclusion, AI improves procedural efficiency, but its use without comprehensive regulation threatens transparency and public trust.
