Abstract

Abstract: This thesis analyzes Constitutional Court Judgment No. 2167-21-EP/22 regarding the pollution of the Monjas River in Ecuador, through the lens of Sustainable Development Goal 13: Climate Action. It examines how this ruling represents significant progress in environmental justice by recognizing the State s obligation to prevent and remedy environmental harm affecting vulnerable communities. The research explores the link between the right to a healthy environment and effective access to justice as key mechanisms for climate change protection. Through doctrinal, legal, and jurisprudential sources, the study demonstrates that this case sets an important precedent for strengthening environmental institutions in Ecuador. This work contributes to the academic and legal reflection on the need to guarantee effective judicial mechanisms to address climate challenges, thereby promoting sustainability and ecological justice.
