Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This thesis analyzes the reasoning in judgments issued by first-level judges in Ecuador, with an emphasis on compliance with the standards of sufficiency and correctness required by the Constitution, the Organic Law of Jurisdictional Guarantees and Constitutional Control (LOGJCC), and national jurisprudence. The case study used was the protection action filed by NNNN against NN, for violation of the rights to work and legal security. The methodology applied was analytical and documentary, breaking down the judgment into its main elements: facts, legal problems, issues, answers, reasons, solution, and decision, and evaluating its normative and factual basis. The results show that the judge complied with the standards of reasoning, although opportunities for improvement were identified in the development of complementary doctrinal criteria. It is concluded that proper motivation strengthens transparency, due process, and the legitimacy of the Ecuadorian judicial system, becoming an essential tool for the protection of rights.
