Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: In the field of jurisprudence, the motivation of a judgment is the responsibility and reasoning that the judge uses to clearly, reasonably, and sufficiently explain the reasons for their decision, guaranteeing a fair trial and the right to due process. This study aimed to analyze and evaluate the correct and sufficient motivation of the judgments issued by first-level judges in Ecuador. To this end, an analysis of the motivation of the judgment in case No. 11282-2023-04076, Robbery Offense, was conducted. The elements that comprise the judgment were identified, and the judgment was evaluated using the sufficiency standard and the correct motivation questionnaire. This allowed us to determine whether the judge acted in accordance with the regulations, respecting due process, and whether the judgment should be corrected by an appellate judge. The analysis of the rulings aims to demonstrate whether the judges involved justify their decisions honestly, complying with the guarantee of legal security of due process.
