Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The proposed research focuses on elucidating the problem of the large number of judgments issued by first-level judges in Ecuador and whether these comply with the guarantee of reasoned decision-making as established by law. It is argued that a considerable number of first-level rulings are issued daily, which may affect the quality of the argumentation in these rulings. From the perspective of other authors, as well as from the legal framework, a complete and detailed description of what reasoning represents and its importance in guaranteeing the right to defense is provided. In a practical manner, the reasoning of a first-level judgment is analyzed with the appropriate methodological approach, which will eventually lead to the results that will be discussed, in order to determine whether this important part of due process is being adequately fulfilled, guaranteeing effective judicial protection and the administration of justice in the actions of judges at this level.
