Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract:This paper analyzes the correct and sufficient motivation in the judgments issued by first-level judges in Ecuador, using Judgment No. 06335-2024-04203 as a case study. Through the method proposed by Manuel Atienza and the standards defined by the Constitutional Court, the normative and factual basis applied by the judge, as well as the argumentative quality of the ruling, will be evaluated. This analysis indicates that the judgment meets the requirements of sufficient and correct motivation, having applied the current educational regulations and justifying the absence of violations of the rights that were alleged. It also indicates that no horizontal or vertical appeals were filed in the process, concluding in a single judicial instance. This study contributes to the understanding of motivation as a guarantee of due process and as a tool to strengthen the transparency, control, and legitimacy of judicial decisions.
