Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: Ecuador is a constitutional state of rights and justice, guaranteeing human, collective, and environmental rights, in which all norms, authorities, and citizens must submit to the Constitution, promote, protect, and respect constitutional guarantees. From this perspective, a reasoned judgment that meets all parameters guarantees effective judicial protection, transparency, and oversight of judicial decisions, allowing citizens to access justice reliably, strengthening the justice system and democracy. This research corresponds to an analysis of the reasoning behind a judgment issued by a first-level judge in a case concerning the termination of alimony in a de facto union. For the development of this work, a bibliographic and doctrinal investigation was carried out on the right to alimony and the Ecuadorian regulations regarding the subject, likewise the motivation test was applied to the sentence issued in this case, reaching the conclusion that it lacks sufficiency and factual logical coherence.
