Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This research paper is based on a concrete analysis of the motivation in a judgment issued by a judge of first instance in labor matters, taking motivation as the central axis for validity and a guarantee of due process. This work starts from the hypothesis of the existence of a practical problem, which is to determine whether the judgment lacks sufficient and correct motivation, which can determine the validity of the judgment. The study uses the analytical and descriptive method of the facts and arguments developed throughout the judgment with the objective of demonstrating that motivation is a determining factor for validity at all stages; concluding that the judgment has managed to comply with all the requirements.
