| Abstract: | Abstract: The topic of this research is the motivation behind judgments issued by first-level judges in Ecuador. The general objective of this thesis is to analyze and evaluate the correct and sufficient motivation in the judgments issued by these judges. The selected judgment is No. 16201-2023-00184, concerning family law related to women, children, and adolescents, specifically regarding the determination of child support payments. The research was conducted in the canton of Saquisilí. The analytical method used was the analysis of the judgment's motivation, employing the "EL SER" method to distinguish relevant elements and break down its fundamental arguments for analysis and evaluation. The techniques used included outlining the arguments and administering questionnaires on the standard of sufficiency and correct motivation. The SATJE system was used to download the judgment, and several websites were consulted for the doctrinal and jurisprudential analysis. In conclusion, through the analysis and evaluation of the selected first-level ruling, it constitutes all the parameters of a correct and sufficient motivation. |
| Description: | Resumen: El tema de la presente investigación es motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador. El objetivo general del trabajo de titulación es analizar y evaluar la motivación correcta y suficiente en cuanto a las sentencias emitidas por los jueces de primer nivel. La sentencia seleccionada es la Nro.16201-2023-00184 en materia de derecho de la familia mujer, niñez y adolescencia en cuanto a la fijación de la pensión alimenticia. Se realizó la investigación en el cantón Saquisilí. Se utilizó el método de análisis, la metodología es el análisis de la motivación de la sentencia, el método EL SER para distinguir elementos relevantes, descomponer sus argumentos fundamentales para analizar y evaluar. Las técnicas utilizadas: esquematización de las argumentaciones, cuestionarios de estándar de suficiencia y motivación correcta. Sistema SATJE para la descarga de la sentencia, para el análisis doctrinario jurisprudencial se utilizó varios sitios web para consultar en la base de datos. En conclusión, a través del análisis y evaluación de la sentencia de primer nivel seleccionada, constituye todos los parámetros de una motivación correcta y suficiente. |
