Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This Curriculum Integration Project focuses on analyzing the motivation behind the ruling issued by the presiding judge of the first level, Dr. Wilmer Ismael Zambrano Ortiz, in case No. 17230-2022-06499. The project aims to investigate and analyze the ruling and determine whether it is properly motivated, whether there are motivational deficiencies such as insufficiency, absence, or apparent lack of motivation, or whether there are procedural flaws. To conduct an optimal and in-depth analysis, the analytical method was used, which involves breaking down the ruling into its fundamental parts to analyze and evaluate the judge's arguments. The result of the analysis provides a focus and direction for the ruling based on the sufficiency of the motivation regarding the factual and legal aspects. Motivation is the main axis for providing a resolution in the judgments issued by the administrators of justice, and a judgment cannot exist if it is not properly motivated.
