Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: This thesis examines the motivation in the rulings issued by first-level judges in Ecuador, highlighting its crucial role in ensuring transparency, justice, and effective judicial protection. Through a thorough analysis of the fundamental principles governing judicial motivation, its impact on decision-making, and the legal implications of insufficient motivation, this study explores how proper motivation ensures decisions are clear, well-reasoned, and respectful of the rights of the parties involved. The study also addresses how judicial motivation impacts the protection of fundamental rights, such as the right to identity and the right to a fair trial, as well as the possibility of challenging rulings due to deficiencies in the reasoning. Finally, a critical reflection is provided on the need to strengthen judicial motivation in Ecuador, proposing improvements to enhance coherence and transparency in the judicial system, with the aim of ensuring the legitimacy of the process and the effective protection of citizens' rights.
