Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: The objective of this thesis is to analyze the judgments issued by first-level judges in Ecuador, in order to determine whether they comply with the constitutional and legal standards required by the Ecuadorian legal system. This research was based on the provisions of the Constitution of the Republic and the Organic Code of the Judiciary, particularly regarding the right to due process and the obligation to provide reasons for judicial decisions. The study of the judgments was developed using a qualitative approach, applying analytical and deductive methods. What we did was a documentary analysis of the judgments issued by the judges of the first level, where the normative, factual, and logical reasoning of the judicial decisions was reviewed. The results obtained in the analyzed judgment of adverse possession were that the judgment complies with the evidentiary and reasoned justification.
