Motivación en las Sentencias Emitidas por los Jueces de Primer Nivel en Ecuador

Abstract

Abstract: This work develops a doctrinal and jurisprudential analysis of the judgment issued in the case of J.Y.M.V., corresponding to criminal proceedings No. 08282-2022-06433, for the crime of breach of trust. This study examines the argumentative structure of the judgment, highlighting the extent to which the court correctly applied Article 187 of the Comprehensive Organic Criminal Code (COIP) to guarantee due process and judicial reasoning. A doctrinal review demonstrates that adequate motivation is the basis of judicial reasoning and an important element in the protection of fundamental rights. The main contribution of this work is to demonstrate that sound judicial decisions not only legitimize the judicial function but also improve citizens' trust in the criminal justice system.
