Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract

Abstract: Over time, laws have changed for the benefit of citizens; however, a positive change has not been achieved. In 2015, at the United Nations convention, an agenda called the Sustainable Development Goals (SDGs) was launched, which would replace the Millennium Development Goals (MDGs). This new agenda is in effect for 15 years and is linked to one of the 17 goals related to civil law, as well as to ruling No. 341-14-EP/20. Objective No. 16 deals with peace, justice, and strong institutions, so the topic to be addressed will be the violation of constitutional rights, which were violated against an elderly person who is illiterate. Their lack of knowledge about their rights allowed irregularities in the judicial process, causing serious harm. Their humility and lack of resources prevented this person from accessing a fair and transparent defense. Therefore, we will address this issue, which will allow us to identify the existing flaws in a judicial process and link it to the agenda.
