dc.descriptionResumen:En el presente trabajo de investigación se procedió a un minucioso análisis de la motivación contenida en la sentencia emitida por la Jueza de primera instancia. El objetivo primordial consistió en escrutar dicha motivación, evaluando su pertinencia y suficiencia conforme a los estándares constitucionales. Cabe destacar que este estudio corresponde a un proyecto integral de titulación de la carrera de Derecho de la Universidad Técnica Particular de Loja (UTPL), orientado a examinar y valorar críticamente la fundamentación de las sentencias dictadas por jueces de primera instancia en el sistema judicial ecuatoriano. La aplicación del cuestionario especializado para verificar la suficiencia y pertinencia de la motivación arrojó resultados concluyentes puesto que la sentencia analizada satisface plenamente la garantía de motivación adecuada, en estricto cumplimiento del artículo 76 de la CRE y la consolidada jurisprudencia de la Corte Constitucional. En resumen, el análisis de la motivación judicial fortalece las habilidades interpretativas de los estudiantes y profesionales del Derecho y establece un control académico efectivo sobre la labor de los jueces. Así se fomenta la responsabilidad en la justicia, garantizando el debido proceso y la defensa de los derechos fundamentales.es_ES
dc.description.abstractAbstract: This research project involved a meticulous analysis of the reasoning contained in the judgment issued by the trial judge. The primary objective was to scrutinize this reasoning, evaluating its relevance and sufficiency against constitutional standards. It should be noted that this study is part of a comprehensive degree project for the Law program at the Universidad Técnica Particular de Loja (UTPL), aimed at critically examining and assessing the grounds for judgments handed down by trial judges within the Ecuadorian judicial system. The use of a specialized questionnaire to verify the sufficiency and relevance of the reasoning yielded conclusive results, as the analyzed judgment fully satisfies the guarantee of adequate reasoning, in strict compliance with Article 76 of the Constitution of the Republic of Ecuador (CRE) and the established case law of the Constitutional Court. In summary, the analysis of judicial reasoning strengthens the interpretive skills of law students and legal professionals while establishing effective academic oversight of judicial work. This fosters accountability within the justice system, thereby guaranteeing due process and the protection of fundamental rights.es_ES
