dc.descriptionResumen:El presente estudio analiza la motivación en las sentencias emitidas por jueces de primer nivel en Ecuador, enfocándose en su rol como garantía del debido proceso en casos de pensiones alimenticias. El objetivo general fue evaluar cómo los jueces fundamentan sus decisiones, asegurando que estas respeten el interés superior del niño y promuevan la corresponsabilidad parental. La investigación se realizó en la Unidad Judicial de Familia, Mujer, Niñez y Adolescencia del cantón Ambato, provincia de Tungurahua, considerando como muestra la sentencia No. 18202-2021-XXXXX. Se adoptó un enfoque cualitativo con métodos descriptivos y analíticos. Las técnicas utilizadas incluyeron el análisis documental y la revisión jurisprudencial, mientras que los instrumentos consistieron en cuestionarios para medir la suficiencia y corrección de la motivación judicial. Los resultados mostraron que la resolución analizada cumplió con los estándares constitucionales, exponiendo de manera clara y coherente los hechos, normas aplicables y razonamientos lógicos que sustentan la decisión judicial. Se evidenció que la motivación judicial garantiza comprensión, transparencia y control democrático. La conclusión general indica que una adecuada motivación fortalece la legitimidad del sistema judicial y asegura la protección integral de los derechos de los menores involucrado.es_ES
dc.description.abstractAbstract: This study analyzes the reasoning provided in judgments issued by trial-level judges in Ecuador, focusing on its role as a guarantee of due process in child support cases. The general objective was to evaluate how judges substantiate their decisions, ensuring they respect the best interests of the child and promote shared parental responsibility. The research was conducted at the Judicial Unit for Family, Women, Children, and Adolescents in the Ambato Canton, Tungurahua Province, using Judgment No. 18202-2021-XXXXX as the sample. A qualitative approach was adopted, employing descriptive and analytical methods. Techniques included document analysis and a review of case law, while instruments consisted of questionnaires designed to measure the adequacy and correctness of the judicial reasoning. The results showed that the analyzed ruling met constitutional standards, clearly and coherently setting out the facts, applicable legal norms, and logical reasoning underpinning the judicial decision. It was demonstrated that judicial reasoning ensures understanding, transparency, and democratic oversight. The general conclusion indicates that adequate reasoning strengthens the legitimacy of the judicial system and ensures the comprehensive protection of the rights of the minors involved.es_ES
