Abstract: Abstract: This research analyzes the evidentiary value of anticipatory testimony in the Gualaquiza Canton (Morona Santiago), evaluating its effectiveness in preventing impunity and revictimization. Using a qualitative approach that combined the doctrinal-legal method with interviews with justice system practitioners and an analysis of court rulings, the study identified procedural weaknesses inherent to the rural setting. Access to case law emerged as a key facilitating factor, whereas limitations included restricted access to sealed case files and geographical or technological barriers in remote communities. The thesis is structured into four chapters, covering everything from theoretical foundations and the legal framework of the COIP (Comprehensive Organic Criminal Code) to technical and cultural challenges and local field findings. This study provides a roadmap for enhancing effective judicial protection and combating impunity in the region.
Description: Resumen:Esta investigación analiza el valor probatorio del testimonio anticipado en el cantón Gualaquiza, Morona Santiago, evaluando su eficacia para evitar la impunidad y la revictimización. Mediante un enfoque cualitativo que combinó el método dogmático-jurídico con entrevistas a operadores de justicia y análisis de sentencias, se identificaron las debilidades procesales del entorno rural. Entre las principales facilidades destacó el acceso jurisprudencial, mientras que las limitaciones incluyeron el acceso restringido a expedientes reservados y barreras geográficas o tecnológicas en comunidades alejadas. La tesis se estructura en cuatro capítulos que abarcan desde los fundamentos teóricos y el régimen jurídico del COIP, hasta los desafíos técnicos, culturales y los resultados de campo locales. Este estudio aporta una hoja de ruta para mejorar la tutela judicial efectiva y combatir la impunidad en la región.
