Los estándares Interamericanos de la Consulta Previa. Estudio del caso Sarayacu Vs Ecuador

Abstract

Abstract: This article analyzes the standards of prior consultation developed by inter-American jurisprudence, with special reference to the case of Sarayacu v. Ecuador, as well as the existing divergence between those standards and Ecuadorian domestic law. In the main, the article shows that in infra-constitutional law anomies and contradictions persist, with respect to inter-American standards, which have also been accepted by the Constitutional Court of Ecuador.
