Motivación en las sentencias emitidas por los jueces de primer nivel en Ecuador

Abstract:In the present work, the development of the importance of motivation in the rulings issued by first-level judges in Ecuador is carried out. The concept of motivation is explained, along with the role it must fulfill at the moment of issuing a decision by the competent judicial bodies, as well as the different types of motivation that exist both those that are useful, such as sufficient and proper motivation, and those that render it deficient and ineffective, such as apparent or incoherent motivation, among others. It also addresses the requirements that the reasoning behind the motivation must meet to be considered valid at the time it is issued, as well as the flaws that may arise within it. The work concludes with an analysis of the motivation in the judgment that is the object of study of this research, in which one can clearly and accurately observe how all the previously discussed characteristics of motivation unfold within society and the legal system.
